Question:

My boyfriends solictor put in a bail application for him friday (hes currently on remand) so can you tell me how long it takes to get to crown court, what happens there and when we will know if he is granted bail? how long does it take?

Answer:

If this is a Crown Court bail application (sometimes called a Judge in Chambers application or "JC") then they are usually heard 48 hours after having been lodged with the Court.

The Crown has a right to 48 hours notice for bail applications so that they can consider the views of the Police and check out any proposed bail addresses.

Where I work, say a Solicitor lodges a written notice of application before 10am on a Monday, the case would be listed before a Judge on Wednesday. Anything after 10am is deemed to be lodged the next day so if it was lodged at 11am on the Monday it wouldn't be heard until the Thursday.

There is no reason for it to take longer than this, however. By the sounds of it, expect a bail application on or before Wednesday.

The application is heard in private and the result is communicated to the remand prisoner by the Court informing the prison and an officer simply passing the result on verbally. The only way you would find out is by either him telling you on the phone or in person, turn up at court, find out who his lawyer is and ask them. They might not tell you though. Some people are funny about that. Confidential I suppose, but not exactly a big deal really. You'd find out either way about an hour later anyway.
